After a frustrating weekend of not being able to do any wars or private room, and getting a stupid 61070 Error code several times, I decided to call nintendo and see what they had to say about this.
Nintendo: We are very sorry for the recently worsening event that has been causing major wi fi issues through out a couple of our games. Nintendo had no Idea that mkwii would ever be this big, and our servers were not meant to take on such a burden. The massive influx of activity do to the fact that everyone bought it for Christmas has really put stress on it, and it has been frequently overloading our servers.
This issue has only been lightly addressed, and their is no effective date determined on when it is going to be fixed. : Nintendo"
